1. Agreement to Terms

By accessing or using Photiq ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Service Description

Photiq is a platform that connects clients seeking photography services with local photographers. We provide:

• Portfolio hosting and discovery for photographers
• Lead generation and consultation request management
• Transparent pricing display
• Direct connection between clients and photographers

3. For Photographers

3.1 Account Registration

Photographers must create an account to access lead generation services. You agree to provide accurate, current, and complete information during registration and to update this information as needed.

3.2 Lead Purchases

Leads and consultation requests are information-based services providing client contact details and project information. Important terms:

• No Guaranteed Bookings: Purchasing a lead or consultation request does NOT guarantee you will book the client. It provides an opportunity to contact and pitch your services.
• Immediate Access: Upon purchase, you receive instant access to client information. This is a completed transaction for an information product.
• Your Responsibility: Success depends on your follow-up, communication, pricing, availability, and fit for the project.
• Shared Leads: Lead pool purchases may be shared with other photographers. Consultation requests are exclusive for 7 days.

3.3 Direct Payment

All transactions between photographers and clients occur directly between parties. Photiq is not involved in payment processing or service delivery for photography bookings.

4. For Clients

4.1 Free Service

Photiq is 100% free for clients. You can browse portfolios, request consultations, and connect with photographers at no cost.

4.2 Direct Agreements

Any agreements, contracts, or payments for photography services are made directly between you and the photographer. Photiq is not party to these agreements and is not responsible for service delivery, quality, or disputes.

5. No Refund Policy

As an information-based lead service, all purchases of leads and consultation requests are final and non-refundable. Upon purchase, you receive immediate access to the information, which constitutes delivery of the purchased product.

We do not provide refunds for:

• Clients who do not respond to your outreach
• Clients who choose another photographer
• Projects that fall through or get cancelled
• Leads that do not result in bookings
• Any change of mind after purchase

6. Prohibited Conduct

You agree NOT to:

• Provide false or misleading information
• Impersonate another person or entity
• Upload copyrighted content you don't own
• Harass, abuse, or harm other users
• Spam or send unsolicited communications
• Attempt to circumvent payment systems
• Scrape or harvest data from the platform

7. Intellectual Property

Photographers retain ownership of all portfolio images uploaded. By uploading content, you grant Photiq a license to display this content on the platform for the purpose of connecting you with clients.

8. Limitation of Liability

Photiq provides a platform for connection only. We are not responsible for:

• Quality of photography services provided
• Disputes between photographers and clients
• Payment disputes or non-payment
• Cancellations or no-shows
• Any damages arising from use of the platform

9. Termination

We reserve the right to suspend or terminate accounts that violate these terms or engage in prohibited conduct.

10. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the platform after changes constitutes acceptance of new terms.
